These Terms of Service (“Terms”) govern your use of mccabetrucking.com (the “Site”) and any freight-brokerage and transportation services provided by McCabe Trucking (“we”, “us”). Acceptance of Terms
By accessing the Site or engaging McCabe Trucking for transportation, warehousing, or related services, you agree to be bound by these Terms and any written rate confirmation, bill of lading, or service agreement between us.
Services
We arrange and provide motor-carrier transportation and warehousing services within the continental United States, subject to applicable FMCSA authority and state/federal law. Rates, transit estimates, and availability shown on the Site are non-binding until confirmed in writing.
Customer Responsibilities
- Provide accurate shipment details (dimensions, weight, commodity, hazmat class, accessorial needs) at time of tender.
- Have the shipment tendered and ready at the agreed pickup window.
- Ensure freight is properly packaged, marked, and — where required — placarded for hazmat.
Rates, Invoicing, and Payment
Rates are quoted per shipment. Accessorial charges (detention, layover, redelivery, lumper, etc.) may apply. Invoices are net 30 days unless otherwise agreed. Past-due balances accrue interest at the lesser of 1.5%/month or the maximum permitted by law.
Liability
Cargo liability is governed by the Carmack Amendment (49 U.S.C. § 14706) and the terms of the governing bill of lading. We are not liable for consequential, special, or indirect damages. Claims must be filed within nine (9) months of delivery or reasonable delivery date.
Intellectual Property
All content, trademarks, and logos on the Site are owned by McCabe Trucking or its licensors. You may not reproduce, republish, or commercially exploit Site content without written permission.
Prohibited Use
You agree not to use the Site to transmit unlawful, infringing, or harmful material, attempt to breach security, or scrape data without consent.
Indemnification
You agree to indemnify and hold McCabe Trucking harmless from claims arising from your use of the Site or breach of these Terms.
Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Venue for any dispute lies in the state or federal courts of Blair County, PA.
Changes
We may revise these Terms. Continued use of the Site after changes means you accept them.
